These Terms of Service ("Terms") govern your access to and use of FindMyHealthQuote.com and any website pages, quote-request forms, call buttons, referral links, content, tools, or services that link to these Terms (collectively, the "Website" or "Services"). By accessing or using the Website, submitting information through a form, clicking a referral link, calling a number displayed on the Website, or otherwise using our Services, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Website or submit information through our Services.

These Terms apply to all visitors, users, and others who access or use our Services. We recommend that you print or save a copy of these Terms for your records.

This is a solicitation of insurance. By using the Website, you acknowledge that the Website and the contact forms constitute a solicitation of insurance by FindMyHealthQuote and its licensed insurance partners.

2. About our service

FindMyHealthQuote is an independent insurance information, quote-referral, and lead-generation website. We are not an insurance company, broker, or agent. We do not underwrite, issue, administer, approve, deny, or guarantee insurance policies. We do not directly process final Marketplace applications unless expressly stated.

Our Services may include:

• Providing general information about ACA-compliant major medical plans, Medicare-related options, short-term medical plans, dental plans, vision plans, and other insurance products or coverage categories.
• Quote-request forms and call-to-action buttons.
• Routing consumers to authorized quoting or enrollment services and licensed insurance professionals for quote, eligibility, plan-comparison, enrollment, and support services.
• Insurance education and partner referral pathways.

FindMyHealthQuote may be operated by or associated with licensed insurance professionals; however, final eligibility review, application submission, enrollment assistance, and post-enrollment servicing may be handled by licensed agents, brokers, agencies, carriers, quoting platforms, or other authorized enrollment partners.

No professional advice. The content on this Website is provided for general informational and educational purposes only. It is not legal, tax, financial, medical, or government-benefits advice. It is not a guarantee that any particular plan, subsidy, premium, benefit, provider network, drug formulary, or coverage option is available or suitable for you. You are responsible for reviewing plan documents, benefits, exclusions, limitations, provider networks, formularies, premiums, deductibles, copays, coinsurance, and eligibility requirements before applying for or enrolling in coverage.

We do not offer every plan available in your area. Any plans or information available through this Website are limited to the carriers, products, and partners available through our network for your ZIP code. Service and referral availability. We may accept an inquiry from a state or ZIP code that we cannot directly serve. We may try to locate an appropriately licensed and authorized partner, but we do not guarantee that one will be available. If no suitable resource is available for your state, location, product, or circumstances, we may be unable to provide a referral or further assistance.

No guarantee of quotes, eligibility, subsidies, enrollment, or coverage. FindMyHealthQuote does not guarantee that you will qualify for any insurance plan, subsidy, premium tax credit, cost-sharing reduction, financial assistance, quote, premium, provider network, drug coverage, enrollment deadline, or coverage approval. Any quote, subsidy estimate, premium estimate, or plan information displayed through the Website is preliminary and subject to verification. Final determinations are made by insurance carriers, government Marketplaces, CMS, state agencies, or other authorized entities, as applicable.

3. No government affiliation

FindMyHealthQuote is not HealthCare.gov, Medicare.gov, the Centers for Medicare & Medicaid Services (CMS), Medicaid, any federal agency, any state Marketplace, any state insurance department, or an insurance company. We are not endorsed by, sponsored by, or affiliated with the U.S. government, the federal Medicare program, or any state or federal Marketplace. We are not connected with the federal Medicare program or with any federal or state government health insurance program.

Medicare-specific. Medicare Advantage and Medicare Part D plans are not connected with or endorsed by the U.S. government or the federal Medicare program. This is an advertisement for insurance. Any $0 premium Medicare Advantage plan referenced on this Website requires that you continue to pay your Medicare Part B premium. Not all plans offer all benefits. Benefits, premiums, copays, and provider networks may change on January 1 of each year. The formulary, pharmacy network, and provider network may change at any time.

4. Eligibility

To use our Services, you must:

• Be at least 18 years of age or the age of majority in your state of residence, whichever is greater.
• Be a resident of the United States or a U.S. territory.
• Have the legal capacity to enter into binding contracts.
• Provide accurate, current, and complete information when submitting forms or requesting quotes.
• Use the Services only for lawful personal, household, or consumer purposes.

You may not use the Services on behalf of another person unless you have legal authority or that person's permission. By using the Services, you represent and warrant that you meet these eligibility requirements. We reserve the right to terminate or restrict your access if we believe you do not meet these requirements.

5. Your information

Certain features of our Services require you to submit personal information, which may include your name, contact information, date of birth, location, household size, income, employment status, eligibility-relevant information, providers, prescriptions, and health-condition indicators.

You agree to:

• Provide accurate, current, and complete information.
• Maintain and promptly update your information to keep it accurate.
• Notify us if you discover any unauthorized use of your information or account.
• Not submit false, fraudulent, or misleading information, and not submit information about another person without authorization.

We are not responsible for losses or damages arising from your failure to provide accurate information. Inaccurate, incomplete, outdated, or misleading information may affect quotes, eligibility estimates, plan availability, subsidy estimates, enrollment results, or partner follow-up. We may investigate suspected violations and take appropriate action, including restricting access, blocking submissions, reporting activity to partners or authorities, and pursuing legal remedies.

6. Communications consent (TCPA, FTSA, state telemarketing)

When you submit your contact information through our Website, call a number displayed on our Website, or otherwise request insurance information, FindMyHealthQuote and/or authorized licensed insurance partners may contact you about your insurance inquiry using the contact information you provide. Consent to receive marketing calls or text messages is not required to purchase insurance.

Prior express written consent (TCPA). Where required by the Telephone Consumer Protection Act (47 CFR § 64.1200), we obtain your prior express written consent before initiating or arranging automated marketing calls, prerecorded or artificial-voice calls, or marketing text messages to the phone number you provide. The consent disclosure is presented above the phone field in our wizard, includes a clear and conspicuous description of the consent (including that you authorize autodialed and prerecorded marketing calls and texts from FindMyHealthQuote and its licensed insurance partners), identifies the seller(s), and is acknowledged by a separate, required checkbox. Consent is not a condition of purchase. Message and data rates may apply.

Opt-out and revocation. You may opt out of marketing text messages at any time by replying STOP. You may revoke consent, request no further contact, or opt out of any channel by using the contact methods in Section 18 or by following the unsubscribe instructions in any message we send. We honor all opt-out and revocation requests within the timeframes required by applicable law (typically 10 business days or less).

Do-Not-Call compliance. We scrub outbound contact numbers against the National Do-Not-Call Registry, applicable state DNC lists, and our internal DNC list before initiating contact.

Call recording. Calls to our phone numbers may be recorded or monitored for quality assurance, training, and compliance purposes. In states that require all-party consent, the call recording notice is provided at the start of the call.

Email (CAN-SPAM). Commercial emails we send include a clear identification of the sender, a valid physical postal address, a clear opt-out mechanism, and are honored within 10 business days.

Partner follow-up. If a partner contacts you after you interact with that partner or are routed to that partner, the partner may be responsible for honoring opt-outs, consent revocations, and communication preferences under its own policies and applicable law.

7. HIPAA status

FindMyHealthQuote is not a "covered entity" or "business associate" under the Health Insurance Portability and Accountability Act (HIPAA) and the HIPAA Privacy and Security Rules (45 CFR Parts 160 and 164). The information you submit through our Website is protected by our security practices and applicable state privacy laws, not by HIPAA. Please do not submit protected health information beyond what the relevant form requires. If you choose to provide additional health information to a licensed insurance professional by phone or through a partner's website, that information is handled by the licensed agency or partner, not by FindMyHealthQuote.

8. Intellectual property

The Website, including its text, graphics, images, logos, icons, layout, design, software, code, and other content, is owned by FindMyHealthQuote, its licensors, or its content providers and is protected by United States and international copyright, trademark, trade secret, and other intellectual property laws.

You may access and use the Website for your personal, non-commercial use only. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, scrape, crawl, or transmit Website content except as permitted by law or with our prior written permission.

All third-party trademarks, names, and logos (including carrier names and Marketplace references) are the property of their respective owners. Reference to any third party does not imply endorsement unless expressly stated. Carrier names referenced in any testimonial or example are for illustrative purposes only and do not imply partnership, endorsement, or sponsorship.

9. Prohibited uses

You agree not to use the Website for unlawful, fraudulent, deceptive, abusive, automated, scraping, data-mining, unauthorized-access, impersonation, spam, malware, reverse-engineering, privacy-violating, intellectual-property-violating, or system-disrupting purposes. Specifically, you agree not to:

• Use any robot, spider, scraper, or other automated means to access the Website for any purpose without our express written permission.
• Attempt to gain unauthorized access to any portion of the Website or any other systems or networks connected to the Website.
• Interfere with or disrupt the operation of the Website or our servers.
• Transmit any viruses, malware, or other malicious code.
• Collect or harvest any personally identifiable information from the Website.
• Use the Website to send unsolicited communications, promotions, or advertisements.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

10. Disclaimers

To the fullest extent permitted by applicable law, the Website and Services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied.

We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, completeness, security, and uninterrupted operation.

We do not warrant that:

• The Website will be uninterrupted, timely, secure, or error-free.
• The information provided on the Website is accurate, reliable, complete, or current.
• Any errors in the Website will be corrected.
• The Website is free of viruses or other harmful components.
• Any insurance product offered by third-party carriers will meet your specific needs or expectations.
• Any particular carrier, plan, premium, subsidy, provider network, drug formulary, or coverage option is or will remain available in your area.

Insurance-related information may change without notice. Plan availability, pricing, benefits, provider networks, formularies, subsidies, and eligibility are determined solely by the insurance carriers, government Marketplaces, CMS, or applicable law. We are not responsible for delays, outages, technical errors, partner-system issues, incorrect third-party data, or unavailable quote or enrollment systems.

Insurance plan disclaimers. ACA-compliant major medical plans generally include minimum essential coverage and coverage for pre-existing conditions when purchased through eligible ACA-compliant channels. Short-term medical plans, limited-benefit plans, supplemental plans, dental plans, vision plans, and other non-ACA products may not cover pre-existing conditions and may not qualify as minimum essential coverage under the Affordable Care Act.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

11. Limitation of liability

To the fullest extent permitted by applicable law, in no event will FindMyHealthQuote, its owners, officers, directors, employees, contractors, agents, affiliates, service providers, licensors, successors, or assigns be liable for any indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, including lost profits, lost revenue, lost data, loss of goodwill, loss of coverage opportunity, or business interruption, arising out of or related to your use of, or inability to use, the Website or Services, even if FindMyHealthQuote has been advised of the possibility of such damages.

To the fullest extent permitted by applicable law, our total liability for any claim arising out of or related to the Website, Services, or these Terms will not exceed the greater of (a) one hundred U.S. dollars ($100) or (b) the amount you paid directly to FindMyHealthQuote for use of the Website in the twelve (12) months immediately preceding the event giving rise to the claim. Because our Services are provided at no cost to consumers, the amount you paid directly to FindMyHealthQuote in any twelve-month period is typically $0.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you. Nothing in these Terms limits any liability that cannot be excluded or limited under applicable law.

12. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless FindMyHealthQuote, its owners, officers, directors, employees, contractors, agents, affiliates, service providers, licensors, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Website or Services.
• Your violation of these Terms.
• Your violation of any rights of another person or entity.
• Your submission of inaccurate, incomplete, misleading, fraudulent, or unauthorized information.
• Your misuse of any quote, referral, enrollment, communication, or partner process.

We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims.

13. Provider accounts and subscriptions

Providers and authorized practice representatives may request access to public provider records and purchase annual profile-management plans after approval. You represent that you are authorized to claim and manage the applicable provider or practice profile and that all profile information you publish is accurate, current, lawful, and not misleading.

Administrator claim review. Each claimant must identify their relationship to the provider or practice and certify that they are authorized to manage the profile. An administrator may compare the request with public records or contact the provider or practice through independently sourced business contact information. We do not request a driver license, selfie, or biometric information for this review. We may approve, reject, suspend, or revoke access when authority is unclear, disputed, false, or no longer current. Approval confirms profile-management authority only; it does not verify professional licensure, credentials, specialty, services, disciplinary history, or quality of care.

Annual subscriptions and seats. Paid provider plans and additional team seats are billed annually at the price displayed during checkout, plus applicable taxes. Subscriptions automatically renew for additional annual terms unless canceled before renewal. You may cancel future renewal through the billing portal; cancellation normally remains effective at the end of the then-current paid term.

No refunds after purchase. Subscription and team-seat payments are non-refundable after purchase except where required by applicable law. Removing a team member, changing a plan, or canceling renewal does not create a refund or credit for unused time unless we expressly agree otherwise or applicable law requires it.

Payment and access. Failed, unpaid, past-due, paused, canceled, or expired subscriptions may lock profile editing, lead management, analytics, custom links, team controls, and other paid tools. The underlying public registry record may remain visible. We may moderate or remove provider-supplied content that is inaccurate, unsafe, infringing, deceptive, or inconsistent with these Terms.

Team administrators are responsible for invited users and permissions. Additional team access is limited to the number of paid seats, and each team member must use an individual account. Account sharing is prohibited.

14. Termination

We may suspend, restrict, or terminate your access to all or part of the Website and Services at any time, with or without notice, for any reason, including if we believe you violated these Terms, submitted improper information, misused the Website, created legal or compliance risk, or otherwise used the Website in a way we consider inappropriate.

You may stop using the Website and Services at any time by ceasing to access the Website and submitting a request to delete your information in accordance with our Privacy Policy.

Sections that by their nature should survive termination will survive, including ownership, intellectual property, disclaimers, limitation of liability, indemnification, dispute, and governing-law provisions.

15. Governing law

These Terms and your use of the Services are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles. If your state of residence provides stronger consumer-protection rights, those rights apply in addition to Florida law.

16. Dispute resolution

Any legal suit, action, or proceeding arising out of, or related to, these Terms or our Services shall be instituted exclusively in the state or federal courts located in Miami-Dade County, Florida, unless applicable law requires otherwise. You and FindMyHealthQuote consent to personal jurisdiction and venue in those courts and waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

Informal resolution. Before filing any claim against us, you agree to first contact us at the email address in Section 17 and attempt to resolve the dispute informally. Your notice should describe the dispute, the relief requested, and your contact information. We will attempt to resolve the dispute in good faith within thirty (30) days after receiving the notice. This informal process does not prevent either party from seeking urgent injunctive or equitable relief where appropriate, and does not apply to claims that cannot be informally resolved as a matter of law.

Nothing in these Terms limits any right you have to pursue a complaint with a state Department of Insurance, the Federal Trade Commission, the Centers for Medicare & Medicaid Services, a state Attorney General, or any other applicable regulator.

17. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms with a new "Last updated" date and, where required by law, provide additional notice.

Your continued use of the Website after updated Terms are posted means you accept the updated Terms. If you do not agree to the updated Terms, stop using the Website.
